General Terms and Conditions of Sale

These General Terms and Conditions of Sale (hereinafter “Terms”) govern the offer and sale of agricultural products, in particular extra virgin olive oil (hereinafter ‘Products’), on the website agriturismocasalicchio.it (hereinafter “Site”) by:

These Terms and Conditions are drawn up in accordance with Legislative Decree 206/2005 (“Consumer Code”) and Legislative Decree 70/2003 (regulation of electronic commerce).
Art. 2 – Definitions
- Seller: The entity identified in Art. 1.
- Customer: Any natural or legal person who purchases Products through the Website. If a natural person, they are considered a “Consumer” if they act for purposes unrelated to any entrepreneurial, commercial, craft, or professional activity they may carry out.
- Website: The e-commerce website agriturismocasalicchio.it.
- Contract: The distance selling agreement between the Seller and the Customer.
Art. 3 – Subject of the Contract and Acceptance
3.1. The Seller offers for sale the Products available on the Website at the time the order is placed. The main characteristics of the Products (e.g., size, cultivar, vintage) are described in the relevant product sheets.
3.2. By placing an order, the Customer declares that they have read all the information provided during the purchase process and fully accept these General Terms and Conditions of Sale and Payment.
Art. 4 – Conclusion of the Contract (Purchase Process)
4.1. Product prices are expressed in Euros (€) and are
inclusive of VAT (Value Added Tax).
4.2. Shipping costs are not included in the Product price but are indicated and calculated at the end of the purchase process (checkout) before payment is made.
4.3. To purchase, the Customer must select the Products, add them to the cart, enter the shipping and billing information, choose a payment method, and confirm the order.
4.4. The order sent by the Customer is considered a
contractual proposal.
4.5. The Sales Contract is only considered concluded when the Seller sends the Customer an
order confirmation email, containing a summary of the Products purchased, prices, shipping costs, delivery address, and a reference to these Terms and Conditions.
Art. 5 – Payment Methods
5.1. The Seller accepts the following payment methods:
Credit Card (Stripe) or
Bank Transfer (in the case of bank transfer, the order will only be processed after the amount has been credited to the Seller's bank account).
5.2. Payment data is managed on secure, encrypted platforms. The Seller does not store complete credit card details.
Art. 6 – Shipping and Delivery
6.1. The Seller undertakes to process the order within 2/3 working days of receiving confirmation of payment.
6.2. Shipments are made by express courier to the address indicated by the Customer. Delivery times are indicative and may vary (e.g., 24/48 hours for Italy, 3-5 days for islands or remote areas).
6.3. The Seller is not responsible for delays attributable to the courier or to force majeure.
6.4.
Upon delivery, the Customer is required to check:
- That the number of packages corresponds to that indicated in the transport document.
- That the packaging is intact, undamaged, not wet, and not altered.
6.5. Any damage to the packaging and/or the Product must be
immediately reported to the courier, by writing
“ACCEPTED WITH RESERVE” on the transport document and specifying the reason (e.g., “wet package,” “damaged box”). Without this wording, the Seller will not be able to claim compensation from the courier. The Customer must also notify the Seller of the incident within 3 days of receipt.
Art. 7 – Right of Withdrawal (Change of Mind)
7.1. Pursuant to the Consumer Code, the Customer (if a Consumer) has the right to withdraw from the Contract, without penalty and without specifying the reason, within
14 (fourteen) days from the date of receipt of the Products.
7.2. To exercise the right of withdrawal, the Customer must inform the Seller by sending an explicit communication (e.g., email to
info@agriturismocasalicchio.it) or by using the “Request Return” function in the account area of the Website.
7.3.
EXCEPTION TO THE RIGHT OF WITHDRAWAL: Pursuant to Article 59, paragraph 1, letter e) of the Consumer Code, the right of withdrawal is excluded for the “supply of sealed goods that are not suitable for return for reasons of hygiene or health protection and have been opened after delivery.”
7.4. Therefore, withdrawal is only applicable if the Product (bottle or can) is
perfectly intact, sealed, unused, and in its original packaging.
7.5.
Effects of Withdrawal (for eligible products):
- The Customer must return the Products intact to the Seller within 14 days of the date on which they notified the withdrawal.
- The shipping costs for returning the Products are borne by the Customer.
- The Seller will refund the cost of the returned Products (excluding return shipping costs) within 14 days of receiving the return, using the same payment method used by the Customer for the purchase, after verifying the integrity of the Products.
Art. 8 – Legal Guarantee of Conformity
8.1. All Products sold on the Site are covered by the Legal Guarantee of Conformity (for Consumers) for defects existing at the time of delivery, which become apparent within 2 years.
8.2. A lack of conformity exists when the product:
- Is not fit for the purpose for which goods of the same type are normally used.
- Does not conform to the description given by the Seller.
- Is damaged or not intact (e.g., broken bottle, product altered not due to transport but due to an original defect).
8.3. In the event of receiving damaged or non-compliant products (other than those ordered), the Customer is required to contact the Seller immediately (as described in the “
Returns and Refunds Policy”) attaching photographic evidence.
8.4. In the event of a proven defect, the Customer is entitled to a replacement Product or a full refund, at the Seller's expense (including all shipping costs).
Art. 9 – Privacy and Data Processing
9.1. The Customer's personal data is processed by the Seller in accordance with the provisions of EU Regulation 2016/679 (GDPR).

Art. 10 – Applicable Law and Jurisdiction
10.1. These Terms and Conditions and the Sales Contracts are governed by Italian law.
10.2. For any dispute relating to the application, execution, and interpretation of these Terms and Conditions, if the Customer is a Consumer, the mandatory territorial jurisdiction is that of the court of the place of residence or domicile of the Consumer.
Art. 11 – Online Dispute Resolution (ODR)
11.1. Consumer Customers are informed that the European Commission provides a platform for alternative out-of-court dispute resolution (ODR platform), accessible at the following link:
